1. Who we are
HyperSites is a web design studio based in Alberta, Canada. We build, host, and update websites for small and local businesses across Canada. You can reach us any time at support@hypersites.work.
2. The free preview
When you give us your business name, we build a working preview of a website for you at no cost and with no obligation. To do that we use information your business has already made public — your Google Business Profile, existing website, social pages, and similar sources.
- The preview is ours until you approve and pay for it. You may share the private link with people in your business to review it.
- You may not copy the preview's design or code, or have someone else rebuild it, without paying the build fee.
- If you don't want it, tell us (or say nothing). We archive the preview and you will never be billed for it.
- Preview links are private but not secret — anyone with the link can view it. Don't post it publicly.
3. What we provide
Our current offer is described on our pricing page. In short:
- One-time build ($499 CAD). A custom-designed, mobile-first website with domain and SSL setup, a contact form, and basic local SEO, delivered once you approve the preview.
- Complete Package ($599.99 CAD, then $19.99 CAD / month). The build above plus managed hosting, domain and SSL management, security, backups, performance and uptime monitoring, website fixes, priority support, access to the HyperSites iOS app, and two small content-update requests per month (changes to existing text, photos, hours or services — new pages, redesigns and custom features are quoted separately). At launch we also help you set up or connect your Google Business Profile and include one additional content update, on top of your first month's allowance.
Prices are in Canadian dollars and exclude tax. HyperSites is GST-registered: 5% GST is added to every invoice and shown as its own line ($499 + $24.95 GST = $523.95 for the One-Time Build; $19.99 + $1.00 GST = $20.99 per month for the Complete Package). We may change our prices for new customers at any time; your monthly rate stays as quoted on your invoice for as long as your plan is active.
4. Approval, revisions, and going live
- Before you pay, we'll make reasonable revisions to the preview so it reflects your business accurately.
- When you approve the site (by telling us in writing, through the preview link, or by paying the invoice), the build is considered accepted.
- After approval and payment we connect your domain and put the site live. If you don't yet own a domain we'll register one for you; domain registration fees, where they apply, are passed through at cost and shown on your invoice.
- Content changes after launch are covered by the monthly plan. Larger work — a redesign, new pages, new features, e-commerce, or integrations — is quoted separately before we start.
5. Invoices and payment
- We invoice by email with a secure payment link. Invoices are due by the date shown on them.
- We accept PayPal (including major credit cards through PayPal) and, when offered, Interac e-Transfer. Card and bank details are handled by the payment provider — we never see or store them.
- Monthly hosting is billed automatically each month through PayPal autopay. You'll receive a receipt for every charge.
- If a payment fails or an invoice goes unpaid for 14 days after its due date, we may pause updates and, after written notice, take the site offline until the account is settled. We will always email you before doing so.
- Invoices are numbered sequentially (for example HS-1001). Please quote the invoice number when you contact us about a payment.
6. Refunds and cancellation
- Build fee. Because you see and approve the finished website before paying, the $499 build fee is non-refundable once paid.
- Monthly plan. No contract, no minimum term. Cancel any time by emailing us; the plan ends at the close of the billing month already paid for. We don't prorate or refund the current month. Managed hosting, your content-update allowance, and HyperSites iOS app access are part of the active plan and end when it does; you keep your site and receive the export described in section 7.
- If we can't deliver. If for any reason we can't put your approved site live, we'll refund what you've paid for that build in full.
7. Who owns what
- Your site is yours. Once the build fee is paid, you own the website we delivered — its pages, design as delivered, and all the content on it. If you leave the monthly plan, we'll give you an export of your site and the details you need to host it elsewhere.
- Your content is yours. Your logo, photos, text, and brand stay your property. You give us permission to use them to build, host, display, and promote your site.
- Our tools stay ours. We keep ownership of the templates, components, build tools, and know-how we use to make websites, and we may reuse them for other clients. That never includes your content or your brand.
- Portfolio. We may show your finished site as an example of our work. Email us if you'd rather we didn't, and we'll leave it out.
- Domains. If we register a domain for you, it is registered in your name or on your behalf and you may transfer it out at any time after the initial registration period required by the registrar.
8. Your responsibilities
- Make sure the information on your site is accurate and that you have the right to use every logo, photo, name, and piece of text you give us.
- Don't ask us to publish anything unlawful, misleading, defamatory, or infringing, and don't use a site we host for spam, malware, or anything that would harm others or our hosting providers.
- Keep your contact email current so invoices and important notices reach you.
- Tell us promptly if something on your site is wrong — we can only fix what we know about.
9. Hosting, uptime, and updates
- We host on reputable third-party infrastructure and aim for your site to be available at all times, but we can't promise uninterrupted service. Brief outages caused by our providers, maintenance, or events outside our control can happen.
- The Complete Package includes two content-update requests per month — ordinary day-to-day changes like existing text, photos, hours, or services. We handle them promptly, usually the same business day. This doesn't cover redesigns, new pages, or new features, which are quoted separately (see section 4).
- We keep backups of hosted sites. If you cancel, we keep a copy for 30 days so you can request an export, then delete it.
10. No guarantees of results
We build good websites, but we can't guarantee any particular business outcome — search rankings, traffic, leads, or sales depend on many things outside our control. Except as expressly stated in these terms, our services are provided “as is” and we disclaim all other warranties to the extent the law allows.
11. Limits on our liability
To the fullest extent permitted by law, HyperSites is not liable for indirect, incidental, or consequential losses (including lost profits, lost data, or business interruption) arising from our services. Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that can't be limited under the laws of Alberta or Canada.
12. Claims caused by your content
If a third party makes a claim against us because of content you supplied — for example an image you didn't have the rights to use — you agree to cover the reasonable costs we incur dealing with it.
13. Ending the relationship
You can stop working with us at any time (section 6). We may end services with 30 days' written notice, or immediately if you breach these terms, don't pay, or use a hosted site in a way that harms us or others. On termination for any reason, you keep your paid-for site and we'll provide the export described in section 7.
14. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Any dispute will be resolved in the courts of Alberta, though we'd much rather sort things out with an email first.
15. Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. For existing monthly customers, material changes take effect 30 days after we email you about them; continuing to use the service after that means you accept the updated terms.
